Title Agent

Issues title insurance policies for an appointed title insurer, and Washington licenses only the business entity: the individuals working under it are exempt from licensing by name. The qualification is property rather than paper, a complete set of tract indexes for every county the agent writes in, plus $200,000 of fidelity cover and a $10,000 surety bond.

    No state exam for this license

    A tract index for every county written in

    • Ownership or a lease of, and maintenance of, a complete set of tract indexes of the county or counties in which the agent will do business, which a nonresident applicant owes for every Washington county it will issue policies in just as a resident does

    and a lawfully established place of business

    • A lawfully established place of business in Washington for a resident agent; a nonresident agent must be licensed in its home state and maintain an established place of business there

    and fidelity cover, and a bond behind its deductible

    • A fidelity bond or fidelity insurance of $200,000 in the aggregate with a deductible no greater than $10,000, covering the applicant and each corporate officer, partner, escrow officer and employee doing escrow work, plus a $10,000 surety bond running to the state unless that fidelity cover carries no deductible at all; a guarantee from a licensed title insurance company accepting responsibility up to $200,000 may stand in place of the fidelity cover

    and an appointment, and the power to hold one

    • Appointment as agent by one or more authorized title insurance companies, and empowerment to be a title insurance agent by the members' agreement of a limited liability company or by the articles of incorporation

    RCW 48.17.090(4) is the granting subsection and it opens "A resident business entity acting as a title insurance agent", which is why there is no individual version of this license: RCW 48.29.170 exempts title insurance agents from the requirement that each individual exercising a licensed firm's authority be separately licensed, and the Office repeats it, "Individual licenses for the employees of a licensed title agent are not required."RCW 48.29.160 is the plant requirement in one sentence and it is the county clause, and it is worth setting beside Idaho, which reaches the same fact the other way: Idaho Code 41-2710 issues a separate title agent license for each county at $50 each, where Washington issues one license and asks for a tract index in each county the agent writes in. Washington's fee is $50 per location. RCW 48.29.155(1)(b) makes the surety bond conditional on the fidelity cover's deductible, and 48.29.155(4) makes both a condition precedent to transacting at all rather than a filing made once. No examination and no course appear anywhere in the chapter.

No national seller sells a course for this license. Washington publishes no title agent examination, its portion pass report names none, and the qualification is a tract index for every county the agent writes in plus fidelity cover and a bond.
