    Plan of operation

    • A detailed plan of operation naming target markets and geographic locations, marketing and advertising strategies for attracting owners and viators, representative training procedures, and the procedures used to keep owner, viator and insured information confidential.

    and financial responsibility

    • A $250,000 surety bond issued by an insurer authorized to write surety in Tennessee, or a $250,000 errors and omissions policy from an insurer licensed to sell it here.

    and character

    • A biographical affidavit for every officer, director and key management professional, on the Department's attached form.

    • An anti-fraud plan submitted with the application.

    The Department uses one form for the provider and the broker, headed "Choose One", and prices both at a nonrefundable $500. What separates them is the work rather than the paperwork: a provider buys the policy. The packet points at Tenn. Code Ann. 56-50-101 through 56-50-117 for the rest and requires viatical settlement contracts and disclosures to be filed and approved before use. A nonresident applicant files a certificate of good standing from the home state, or, where that state licenses nobody in this business, says so. There is no examination and no course. The representative training procedures the plan of operation has to describe are the applicant's own, and the Department approves no course behind them.
