The Oklahoma Managing General Agent license

Managing General Agent

Runs all or part of an insurer's book in Oklahoma, appoints producers for it and can terminate them. The Act that governs it grants nothing on its own, because it asks the applicant to be a licensed producer first, and what makes it a license here rather than an appointment is that the legislature prices it separately.

  1. Route 1 Hold a producer license, then take the managing general agent license

No state exam for this license

    The producer license underneath it

    • an Oklahoma insurance producer license, which 36 O.S. 1473(A) requires before anybody may act as a managing general agent for risks located in this state

and the application the Commissioner has to approve

    • At least eighteen years old, no act that is a ground for denial under 36 O.S. 1435.13, the fees at 1435.23 paid, and a showing under 1435.7(C) that the applicant is competent, trustworthy, financially responsible and of good personal and business reputation. A managing general agent representing an insurer domiciled in Oklahoma with respect to risks located outside the state must also be licensed as a producer here.

The Managing General Agents Act is 36 O.S. 1471 and following, added by Laws 1991, c. 134. 1473(A) is the granting sentence and it grants a permission rather than a document: "No person shall act in the capacity of a managing general agent with respect to risks located in this state for an insurer unless such person is licensed as a producer pursuant to the Oklahoma Producer Licensing Act."Four states on this site answer that shape by refusing the license a page: Iowa, Oregon, Washington and Montana all read it as an eligibility a producer already holds. Oklahoma is built the other way because two things point the other way, and both are the state's own: the Department names the Managing General Agent on its list of the license types it issues and defines it there, and 36 O.S. 1435.23(A)(4)(h) prices a "Managing general agent's biennial license" at $60 in the legislature's own fee schedule. A license the legislature prices separately is a license. There is no examination for it and no course, and 1476 is what the license is really for: the acts of a managing general agent are imputed to the insurer that appointed it.

The Oklahoma products sellers do carry are all for a producer line or for the adjuster; Aceable sells nothing in Oklahoma at all. Oklahoma asks for no course here and its examination vendor publishes no paper for this license, so there is nothing to sell.
