The Oklahoma Insurance Adjuster license

Insurance Adjuster

Investigates claims, adjusts losses and negotiates settlements for an insurer in Oklahoma. One license carries both halves of the trade, the independent adjuster who sells the service and the company or staff adjuster on an insurer's payroll, and the applicant names the classes of business it is to cover.

Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination, a designation already held or a license held in another state.

  1. Route 1 Pass the examination for the classes applied for

    State exam required

    The examination

    • An examination approved by the Commissioner, taken personally, passed within two years before the application, and written under the supervision of the Commissioner or an approved administrator. The vendor gives five Oklahoma adjuster papers at $20 each: Property and Casualty, Casualty, Property, Crop and Hail, and Workers Compensation. Fail twice and thirty days must pass before a third attempt.

and the qualification the Commissioner has to find

    • Experience or special education or training of sufficient duration and extent with reference to the handling of loss claims under insurance contracts to make the applicant competent to fulfill the responsibilities of an adjuster. 36 O.S. 6206(A)(5) sets no period and names no course, so nothing here can be counted in months or in hours.

    and age, residence and character

    • At least eighteen years old, a trustworthy person, and either a resident of Oklahoma or a resident of a state or country that lets Oklahoma residents act as adjusters there. A resident licensee must also keep a place of business in Oklahoma accessible to the public under 36 O.S. 6215.

36 O.S. 6206(A) is the closed list of what the Commissioner must find and 6208(A) is the examination. There is no pre-licensing course in any of it, and Oklahoma's producer zero is not the reason: the Insurance Adjusters Licensing Act is a separate act from the Producer Licensing Act and it asks for experience or special education or training rather than for hours. 6209(B) is the list of classes an applicant may qualify in, "any one of the following classes of insurance or combinations thereof": property, including marine, inland marine, aircraft and damage to land motor vehicles and trailers; casualty, meaning all lines of liability coverage for bodily injury, personal injury and property damage; workers' compensation; crime and fidelity bonds; crop/hail; and multi-peril crop. Six classes in the statute, six in the examination fee schedule at 6212(A) with motor vehicle physical damage standing in for property, and five papers on the vendor's list. The Commissioner also publishes a study manual for the examination under 6209(C) and may charge up to $40 for it.

  2. Route 2 Show the federal crop certification, for the crop classes only

    Exempt from the state exam

    The federal certification

    • RMA Multi-peril crop adjuster certification from the federal Risk Management Agency, held by an adjuster working with or on behalf of the Federal Crop Insurance Corporation, from United States Department of Agriculture Risk Management Agency

    and age, residence and character

    • At least eighteen years old, a trustworthy person, and either a resident of Oklahoma or a resident of a state or country that lets Oklahoma residents act as adjusters there. A resident licensee must also keep a place of business in Oklahoma accessible to the public under 36 O.S. 6215.

OAC 365:25-3-16(b): "Multi-peril crop adjusters certified by the Federal Risk Management Agency working in partner with, or on behalf of, the Federal Crop Insurance Corporation may obtain a crop/hail or a multi-peril crop license upon presentation of the federal certification without having to take an examination."It reaches those two classes and no others, so an adjuster who wants property or casualty as well sits the paper for them. This is one of eight states here where a federal crop program stands in for something a state would otherwise ask for, and they do not agree on what to call it: Washington calls it pre-licensing education, Hawaii takes the card in place of its paper, Wyoming lets it bypass the exam, Maine names no program at all, and Oklahoma names the certifying agency.

  3. Route 3 Hold the license in a home state that examines for it

    Exempt from the state exam

    • an adjuster license held and in good standing in the applicant's home state, where the applicant passed that state's examination

36 O.S. 6208(B)(2) waives the examination for a nonresident applicant who has passed one in the home state and is currently licensed there, and 6205(B) is the nonresident licensing route it belongs to. 6205(B) also carries the shape this site has met in eight states: where neither the state of residence nor the state of business licenses or examines adjusters, the applicant may declare a home state that does examine and in which the applicant is licensed. Somebody who holds no adjuster license in a home state at all sits Oklahoma's examination. 6208(B)(4) is the resident version, for an applicant who passed a former home state's examination and applies here within ninety days of establishing residence, and 6208(B)(3) reinstates a license of the same class held here within the previous twelve months without a further paper.
