A member or employee of a business entity licensed as an insurance producer, on the death or disability of an individual designated in the business entity application or the license; the designee of a licensed producer entering active service in the armed forces; or anybody else where the commissioner deems the public interest will best be served
RSA 402-J:11, I lets the commissioner issue a temporary producer license for up to 180 days without an examination where it is necessary for the servicing of an insurance business, in three cases. The first two are contingencies about somebody else’s license, a death or disability inside a licensed business entity and a producer entering active service. The third is open: "in any other circumstance where the commissioner deems that the public interest will best be served by the issuance of a license", which makes New Hampshire’s temporary license wider than Alaska’s four closed contingencies and than Rhode Island’s four. What balances it is paragraph II, which is a list of powers rather than of rights: the commissioner may limit the authority by order, may require a suitable sponsor who is a licensed producer or insurer and who assumes responsibility for everything the temporary licensee does, and may revoke the license outright if the interest of insureds or the public is endangered. The license also ends by operation of law when the owner or the personal representative disposes of the business, however much of the 180 days is left. 180 days is the term several states here settle on, among them Illinois, Ohio, Kansas and Colorado, while Alaska allows 90 with one renewal and New York 120.
