    What the Commissioner must find

    • A detailed plan of operation; competence, trustworthiness and an intention to act in good faith; a good business reputation and, for a natural person, experience, training or education qualifying them in the capacity; a certificate of good standing from the state of domicile, for an organization; and a fraud prevention plan

    and evidence of financial responsibility

    • A surety bond complying with NRS 679B.175 in an amount the Commissioner sets, which cannot be less than $250,000, or a deposit of cash or certificates in the same amount

    NRS 688C.200(1) bars operating in or from Nevada as a provider of viatical settlements without the Commissioner's license, and 688C.200(2) makes the application a form and the applicable fees, renewable from year to year on its anniversary and expiring if the fees are not paid. NRS 688C.210 is the substance: on the application and the fees the Commissioner investigates and issues if satisfied on five heads, of which the detailed plan of operation at (a) is asked of the provider alone. (b) is competence, trustworthiness and good faith; (c) a good business reputation and, for a natural person, experience, training or education qualifying them; (d) a certificate of good standing from the state of domicile for an organization; and (e) a fraud prevention plan plus evidence of financial responsibility through a surety bond under NRS 679B.175 of not less than $250,000 or a deposit of cash or certificates. Nothing in the chapter is a course or an hour count. 688C.200(3) lets the Commissioner demand the identity of every stockholder, partner, member, officer and employee at any time, and 688C.200(4) makes a license issued to an organization authorize the partners, members, officers and designated employees named in the application. The $250,000 is security rather than money leaving the applicant's hands, so no cost page totals it.
