The Nebraska Public Adjuster license

Public Adjuster

The only adjuster license Nebraska issues, and it is the policyholder's: 44-9202 defines it around first party claims for loss or damage to an insured's own property. Nebraska licenses no company or independent adjuster at all, and the applicant has to keep an office the public can walk into.

Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination, moving here already licensed, a license already held or a license held in another state.

  1. Route 1 Pass the public adjuster examination

    State exam required

    The examination

    • PSI's Public Adjuster paper, exam series 13-10, 100 items at $43 with a cut score of 70 percent or 70 correct. 44-9208(1) has it test "the duties and responsibilities of a public adjuster and the insurance laws and regulations of this state", and Nebraska sets no limit on retakes and no waiting period between them.

    • A surety bond of at least $20,000, issued by an insurer authorized to write surety in Nebraska, which cannot be terminated without 30 days' written notice filed with the director. 44-9212(3) terminates the authority to act as a public adjuster automatically the moment the bond lapses or becomes impaired.

    • An office maintained in Nebraska "with public access to such office by reasonable appointment or regular business hours". It is asked of a resident and not of a nonresident, whose home state office answers instead.

    Neb. Rev. Stat. 44-9205 is the whole qualification and it is eight findings the director has to make: eighteen years of age, a principal place of residence or of business in Nebraska, no act that is a ground for denial under 44-9211, the fee paid, the examination passed unless exempt under 44-9209, trustworthy and reliable and of good reputation, the financial responsibility of 44-9212, and the office. No course is anywhere in it, and the Department's own list of requirements on its producer licensing page prints the same nine bullets without one. The statute caps the resident fee at $100 and the Department's fee schedule charges $50.

  2. Route 2 Move to Nebraska on another state's public adjuster examination

    Exempt from the state exam

    The other state's license

    • 90 days Previously licensed as a public adjuster in another state on the strength of a public adjuster examination, applying for a Nebraska resident license within 90 days of establishing legal residence, and either currently licensed there or applying within twelve months of that license being cancelled, with the other state certifying good standing.

    • A surety bond of at least $20,000, issued by an insurer authorized to write surety in Nebraska, which cannot be terminated without 30 days' written notice filed with the director. 44-9212(3) terminates the authority to act as a public adjuster automatically the moment the bond lapses or becomes impaired.

    • An office maintained in Nebraska "with public access to such office by reasonable appointment or regular business hours". It is asked of a resident and not of a nonresident, whose home state office answers instead.

    Neb. Rev. Stat. 44-9209(1). Two clocks run at once and both have to be met: ninety days from establishing legal residence in Nebraska, and twelve months from the cancellation of the previous license. The exemption is from the examination only. The bond and the office are asked on every route.

  3. Route 3 Have held the Nebraska license within the last twelve months

    Exempt from the state exam

    • a Nebraska resident or nonresident public adjuster license, terminated within the last twelve months and in good standing at termination

    • A surety bond of at least $20,000, issued by an insurer authorized to write surety in Nebraska, which cannot be terminated without 30 days' written notice filed with the director. 44-9212(3) terminates the authority to act as a public adjuster automatically the moment the bond lapses or becomes impaired.

    • An office maintained in Nebraska "with public access to such office by reasonable appointment or regular business hours". It is asked of a resident and not of a nonresident, whose home state office answers instead.

    Neb. Rev. Stat. 44-9209(2). Somebody who held either the resident or the nonresident Nebraska license is excused the paper if the application arrives within twelve months of termination and they were in good standing at it. 44-9210(1)(c) is the neighboring route for a license that merely lapsed rather than terminated: reinstatement within twelve months of the expiry date, again with no examination, on a reinstatement fee the statute caps at $125 on top of the renewal fee.

  4. Route 4 Hold a home state license in a state that returns the favor

    Exempt from the state exam

    The home state license

    • a resident public adjuster license, current and in good standing in the applicant's home state, where that state awards nonresident public adjuster licenses to Nebraska residents on the same basis

    and financial responsibility

    • A surety bond of at least $20,000, issued by an insurer authorized to write surety in Nebraska, which cannot be terminated without 30 days' written notice filed with the director. 44-9212(3) terminates the authority to act as a public adjuster automatically the moment the bond lapses or becomes impaired.

    Neb. Rev. Stat. 44-9206. The Department's page reduces this to one sentence, that a nonresident applicant "shall be licensed as a public adjuster in their home state and shall pay the $50 application fee", and the statute adds the reciprocity condition and three continuing ones: the home state license has to stay in good standing, the Nebraska license terminates and is surrendered immediately if the home state license ends for any reason unless a new home state with reciprocity has licensed the adjuster, and a change of home state is notified within thirty days with both addresses. The bond is asked of a nonresident too, under 44-9212(1).
