The Nebraska Pre-Need Seller license

Pre-Need Seller

Sells a funeral in advance and holds the money until it is needed. It is a Director of Insurance license written in chapter 12 rather than chapter 44, so it is nowhere near the producer act and it is not the pre-need funeral insurance line of authority.

    The application

    • A written application signed by the proposed seller and verified, on the director's form, naming the applicant and its officers, directors, members or trustees, every agent authorized to make pre-need sales in its name, whether those agents are licensed under 12-1115, whether any pre-need seller license has been suspended, revoked or surrendered before, and whether anybody named has been convicted of fraud or misuse of funds in the past ten years.

    and the financial ability finding

    • The director issues the license unless the applicant cannot demonstrate the financial ability to meet the Burial Pre-Need Sale Act, has misrepresented, is not authorized to transact business here, has the fraud conviction, or has failed the act's terms in a way that impedes compliance. The director may instead ask for more, or issue a temporary license with restrictions and reporting.

    • $100 with the application and $100 on renewal. There is no examination and no pre-licensing course anywhere in the act.

    Neb. Rev. Stat. 12-1108, inside the Burial Pre-Need Sale Act. The whole act is in chapter 12, Cemeteries, and it is administered by the Director of Insurance, which is why it is on the Department's licensing fee schedule and nowhere in chapter 44. It is a different thing from the Limited Line Pre-Need Funeral Insurance line of authority at 44-4054(1)(g): that one sells the insurance policy that funds a funeral, and this one sells the funeral. 12-1105 and 12-1114 are the money, records and trust obligations that follow.

No national seller sells a course for this license. Aceable does not sell Nebraska at all. There is no examination and no course in the Burial Pre-Need Sale Act. The qualification is a financial ability finding by the Director of Insurance, and no seller offers anything for it.
