Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination, a license already held, a license held in another state or moving here already licensed.

  1. Route 1 Pass the examination

    State exam required

    24-A M.R.S. 1420-D(1) asks a resident individual applying for a producer license to pass a written examination unless exempt under 1420-H, and 1420-E(1) is the closed list of what the superintendent must find before approving the application: at least 18 years old, no act that is a ground for denial under 1420-K, the fees under section 601 paid, and the examinations passed for the lines applied for. Paragraph C of that list is where the education requirement used to sit and it now reads "[PL 2007, c. 51, S2 (RP).]", so Maine's zero is a repeal with a citation rather than a reading off an absence. There is no cap on retakes.

  2. Route 2 Be admitted to practice law in Maine

    Exempt from the state exam

    • admission as an attorney at law duly licensed to practice law in Maine

    24-A M.R.S. 1420-H(3)(C): no examination is required of an applicant for a license as a resident title insurance producer who is an attorney at law duly licensed to practice law in this State. Delaware writes the same exemption at 18 Del. C. 1709(c) and stops at title as well; South Dakota exempts attorneys from every line rather than only this one. The admission has to be Maine's.

  3. Route 3 Have held the line in Maine within the last two years

    Exempt from the state exam

    • a similar Maine license covering the Title Insurance Contracts line of authority, held other than under a temporary license within the past 2 years, voluntarily terminated rather than revoked or suspended, with the continuing education requirements met over that period

    24-A M.R.S. 1420-H(3)(A), and every clause of it does work. Somebody who held a similar Maine license for the same kinds of insurance within the past two years sits no examination, provided the earlier license was not a temporary one under 1420-J, the continuing education requirements were met during those two years, the applicant is still fully qualified, and the license was voluntarily terminated. A license that was revoked or suspended closes this route for good, which the paragraph says in its own last sentence.

  4. Route 4 Hold the same line in another state

    Exempt from the state exam

    • an insurance producer license carrying the Title Insurance Contracts line of authority in another state

    24-A M.R.S. 1420-H(1). Somebody previously licensed for the same lines of authority in another state completes no examination. The exemption holds while that other license is current, or if the application arrives within 90 days of its cancellation and the prior state certifies good standing at that point, or the NAIC producer database shows it for the line being asked for.

  5. Route 5 Move to Maine and apply within 90 days

    Exempt from the state exam

    • 90 days Licensed as an insurance producer in another state carrying the Title Insurance Contracts line of authority there, and applying to become a Maine resident licensee within 90 days of establishing legal residence.

    24-A M.R.S. 1420-H(2). Somebody licensed as a producer in another state who moves here has 90 days from establishing legal residence to apply as a resident licensee under 1420-E, written as a duty rather than an option. No examination is required for a line of authority previously held in the prior state except when the superintendent determines otherwise by rule.

No national seller sells a course for this license. Maine publishes a title paper, 12-ME-83 at 45 minutes, and no seller carries a Maine title product.
