    What has to be filed

    • The applicant's name, address and telephone number; the name and address of its agent for service of process in Maine; the name and address of each person beneficially interested in the applicant; the name and address of each person with management or control over it; and the fiduciary agreement on the form at Rule 210

    and the finding the superintendent has to make

    • Satisfaction that the applicant possesses the necessary organization, expertise and financial integrity to supply the services it seeks to offer

    24-A M.R.S. 4348 opens with the date it started: "Beginning January 1, 2020, a person may not act as a pharmacy benefits manager in this State without first obtaining a license from the superintendent in accordance with this section."The older provision, 1913, headed "Registration of pharmacy benefits managers", is repealed, and the vocabulary changed with the section number: Maine licenses where it used to register. 4348(2) is the whole qualification in one sentence and it is a judgment rather than a checklist, that the applicant "possesses the necessary organization, expertise and financial integrity to supply the services sought to be offered". No examination, no course, no bond, no net worth. 4348(3) then lets the superintendent write restrictions onto the license itself, limiting the services that may be supplied or the activities the manager may engage in, which is the same shape the administrator license has at 1905(2). 4348(4) fixes the term at three years, which is the longest license term in Maine insurance law and the reason the Bureau's own page insists on a full resubmission at each renewal rather than a statement that nothing has changed. 4348(7) prices going without at $5,000 a day for every day in violation. The fee is $100 to issue and $100 to renew at 601(28-A), and 601(28), which used to carry it, is now empty. Thirty states here now carry one and the price is the clearest measure of how far apart they are: Alaska licenses one for $20,000 with a statutory duty of care, New Hampshire registers one for $500, and Maine licenses one for $100 on a three-year term.
