The Maine Managing General Agent license

Managing General Agent

Underwrites and binds for an insurer at a scale the statute puts a number on. Maine registers it rather than licensing it, on top of a producer license and an appointment.

The license and appointment underneath it

    • a valid Maine insurance producer license authorizing the applicable kinds of insurance, together with an appointment under 1420-M from the insurer the MGA will act for

and what the registration application has to carry

    • The name and address of the appointing insurer, a statement of the duties the producer is expected to perform on its behalf, the lines of insurance the producer is to be authorized to act in, the written contract required by 1494, and whatever else the superintendent requests

24-A M.R.S. 1493(1) and (2) stack this on the producer license twice over, once for Maine risks written for an insurer licensed here and once for outside risks written for an insurer domiciled here, and in each case the person must hold "a valid Maine producer license and appointment" and be registered. There is no managing general agent paper, so the examination in front of this is the producer examination for the lines concerned. 1493(5)(C) is what the superintendent actually does with the application: if it is complete, a certificate of registration issues, and 1493(6) then ties the certificate's life to two things outside it, the producer license staying valid and the contract with the insurer staying alive. When the insurer terminates the contract under 1495 the certificate expires and the registrant "shall promptly deliver the certificate of registration to the superintendent". What makes this a registration rather than a license is that nothing in it is a finding about the applicant: 1493(3) and (4) leave the bond and the errors and omissions policy to the superintendent's discretion and make neither of them a condition. 1492(3) is the definition and it is quantitative rather than descriptive, which few state MGA definitions are: the person must produce and underwrite gross direct written premium equal to or more than 5% of the insurer's policyholder surplus in any one quarter of the year following its last annual statement, and either adjust or pay claims above a threshold the superintendent sets or negotiate reinsurance on the insurer's behalf. Four kinds of person are then carved out by name, including an underwriting manager under common control with the insurer whose pay is not based on premium volume, and the attorney-in-fact of a reciprocal insurer. The fee is $100 to register and $100 a year at 601(22).

No national seller sells a course for this license. There is no managing general agent paper in Maine. 1493(1) stacks the registration on a producer license and appointment, so the examination underneath it is the producer one, which has a course list on this site.
