    • A detailed plan of operation; competence, trustworthiness and an intention to act in good faith; a good business reputation and experience, training or education qualifying the applicant in the business; a certificate of good standing from the state of domicile, for a legal entity; and an antifraud plan meeting R.S. 22:1801(G)

    La. R.S. 22:1792(A)(1) bars operating as a viatical settlement provider without a license from the commissioner of the viator's state of residence. 22:1792(F) is the investigation and it turns on five findings, of which the detailed plan of operation at (1) is asked of the provider alone: competence, trustworthiness and good faith at (2); a good business reputation with experience, training or education qualifying the applicant at (3); a certificate of good standing for a legal entity at (4); and an antifraud plan under R.S. 22:1801(G) at (5), which the investment agent is not asked for. There is no prelicensing course, no hour count and no examination anywhere in the Part. 22:1792(D) lets the commissioner demand the identity of every stockholder, partner, officer, member and employee at any time, and refuse an entity whose people fall short. 22:1792(E) makes a license issued to a legal entity authorize the partners, officers, members and designated employees named in the application. The license expires on March 1 each year under 22:1792(C), and the renewal must be filed no earlier than January 1 and no later than March 1.
