    • Competence, trustworthiness and an intention to act in good faith; a good business reputation and experience, training or education qualifying the applicant in the business; and a certificate of good standing from the state of domicile, for a legal entity

    La. R.S. 22:1792(A)(2) is what separates this license from the broker's: an investment agent is licensed by the commissioner of the state where the viatical settlement PURCHASER resides, where the provider and the broker are licensed by the state where the viator resides. 22:1792(F) then applies three of its five findings to it: competence, trustworthiness and good faith at (2), a good business reputation with experience, training or education at (3), and a certificate of good standing for a legal entity at (4). The detailed plan of operation at (1) is the provider's alone and the antifraud plan at (5) is the provider's and the broker's, so the investment agent is asked for neither. There is no course, no hour count and no examination. No life producer exception reaches it either: 22:1792(A)(1) lets a life or annuity producer act as a viatical settlement broker and says nothing about the investment agent.
