    • an Idaho producer license, for anybody keeping an office in Idaho or acting as a reinsurance intermediary manager for an Idaho domiciled reinsurer

    • or

      a producer license in another state whose law is substantially similar to the Idaho Reinsurance Intermediary Act, or an Idaho nonresident reinsurance intermediary license, for anybody keeping an office outside Idaho

    41-5103 is written as two sets of conditions rather than as one qualification. Subsection (1) governs the reinsurance intermediary broker, who places cessions and retrocessions for a ceding insurer, and subsection (2) the reinsurance intermediary manager, who binds a reinsurer or runs all or part of its assumed business. Each turns on where the office is and on holding a producer license here or in a state with substantially similar law. 41-5103(4)(a) then issues one thing: "The director may issue a reinsurance intermediary license to any person, firm, association or corporation who has complied with the requirements of this chapter."The Department administers that one license through two application packets and two renewal packets, one headed for the manager and one for the broker, at $80 either way, renewing every two years on the last day of the month the license first issued. The manager is the riskier of the two and the statute treats it so: 41-5103(3) lets the director require a manager to file a bond for the reinsurer's protection and to maintain an errors and omissions policy, and nothing equivalent applies to the broker. 41-5103(4)(a) makes a license issued to a firm or association authorize every member and designated employee, and one issued to a corporation every officer, designated employee and director, all of whom must be named in the application or a supplement. 41-5103(6) exempts Idaho attorneys acting in their professional capacity. There is no reinsurance paper; the examination is the producer one.
