The Idaho Managing General Agent license

Managing General Agent

Underwrites and binds for an insurer at scale. Idaho calls it a separate license type, stacks it on a property and casualty producer license, and expires every one of them on 30 June.

    State exam required

    The license underneath it

    • a separate, active Idaho property and casualty producer license, held before the managing general agent application is made

and the bond, sized by the money handled

    • A surety bond in favor of the state, held in trust for the insureds and insurers whose money the agent handles, of at least 10% of the total funds handled in the preceding year and never less than $5,000, with one bond covering every insurer the agent acts for unless the written agreement or the director says otherwise

and errors and omissions cover, and the contracts behind it

    • An errors and omissions policy of at least $250,000 or 25% of the gross direct written premiums an insurer received in the previous year attributable to the applicant as its managing general agent, whichever is greater; a list of every insurer doing business in Idaho or domiciled here with which the applicant has an MGA contract; and a verified statement on the Department's form that those contracts carry the provisions section 41-1504 requires

41-1503(1) and (2) require an Idaho producer license under chapter 10 before anybody may act as a managing general agent on Idaho risks for a licensed insurer, or for an Idaho domiciled insurer on risks outside the state. The Department narrows that to a class on its own page: "Agencies wishing to act as an MGA in Idaho must hold a separate, active Property and Casualty Producer license before applying for an MGA license."So the paper in front of this is the property and casualty producer paper and there is no MGA examination. Idaho differs from Oregon on the same question. ORS 744.300 makes the managing general agent an indorsement on the producer license with no examination for it; the Idaho Department's own page says "An MGA (Managing General Agent) is a separate license type in Idaho."Same role, same producer license underneath, opposite answers about what the thing is. 41-1503(3) is unusual in making the bond mandatory rather than discretionary, and in sizing it by money handled rather than by a flat figure, with a floor of $5,000 and a 10% rule measured against the preceding year or, for a new agent, against a reasonable estimate of the current one. Only one bond is needed for all the insurers the agent serves. 41-1503(4) leaves the errors and omissions policy to the director, who requires it, at the levels the Department publishes. The term is the shortest of any Idaho license: one year, expiring on 30 June, whatever day it was issued.

No national seller sells a course for this license. There is no managing general agent paper in Idaho. The Department requires a separate active property and casualty producer license first, so the examination underneath it is the producer one.
