    • a Hawaii producer license or a Hawaii reinsurance intermediary license, where the broker maintains an office in this State

    • or

      a Hawaii producer license, or a producer license in another state having a law substantially similar to article 9B, where the office is in another state

    431:9B-102(a) is written round the office rather than round the business: a broker with an office here, directly or as a member or employee of a firm or association or an officer, director or employee of a corporation, must be licensed here; one with an office in another state must be licensed here or in a state whose law is substantially similar. 431:9B-102(d)(1) issues "a reinsurance intermediary license" and a license granted to a firm or association authorizes its named members and designated employees, while one granted to a corporation authorizes its named officers, designated employees and directors. (d)(2) makes a nonresident applicant designate the commissioner as agent for service of process as a condition precedent, and name a Hawaii resident on whom notices and orders may be served. There is no examination, no course and no experience bar anywhere in article 9B. The Division issues the broker and the manager as two license types with two applications and the same $225 and $150 fees, which puts Hawaii with Alaska, Michigan, Texas and Virginia on two licenses and against Oregon, Vermont, Rhode Island, New Hampshire, Maine and Washington on one.
