Who is responsible for the applicant's affairs

The name, address, official position and professional qualifications of every individual responsible for the conduct of the pharmacy benefit manager's affairs, including all members of the board of directors, board of trustees, executive commission or other governing board or committee, the principal officers, the partners or members, and any other person who exercises control or influence over its affairs

431S-3(b) is three items and no more: who runs the applicant, an agent for service of process, and "a nonrefundable issuance fee of $140". The Division's own fee schedule prices the registration at $420 to issue and $140 to renew, so the figure written into the statute is the renewal rather than the issuance, and the commissioner's power at the end of 431S-3(b) to waive or modify the fee on good cause is the only thing that reconciles them. There is no competence finding, no examination, no course and no bond. The registration renews annually by 31 March under 431S-4 and the Division's own instructions. Four states, four answers on the same role, and Hawaii's is the thinnest: Alaska licenses one for $20,000 with a statutory duty of care, Maine for $100 on a three-year term, Oregon on a twelve-month cycle priced at cost, Idaho registers one for $300 a year, and Washington registers the whole family of health care benefit managers at $500.
