Independent Adjuster

Investigates, reports and adjusts on behalf of insurers only, as an independent contractor or an independent contractor's employee. There is one way in and the Division says so in a sentence: there is no reciprocity for adjusters in Hawaii, and every applicant, resident or not, sits the Hawaii Adjuster examination.

    Domicile, which reaches beyond the State

    • Domiciled in Hawaii, or in a state that will permit residents of Hawaii to act as adjusters in that other state

    and experience, special education or training, with no number on any of the three

    • Experience, special education, or training with reference to the handling of loss claims under insurance contracts, of sufficient duration and extent reasonably to make the individual competent to fulfill the responsibilities of an adjuster

    431:9-222(a) is four requirements and no course is among them: domicile here or in a reciprocating state; experience, special education or training of sufficient duration and extent; the examination required by 431:9-206; and the fees. Paragraph (2) is the shape Idaho writes at 41-1104(1)(c) and Washington at RCW 48.17.380(3)(d), a competence test with no hours attached, so there is no figure a school could sell against. 431:9-206 puts the paper on "each applicant for license as an adjuster or independent bill reviewer" with no exemption anywhere in the article, and the Division states the consequence in one sentence: "There is no reciprocity for adjusters. All individuals - residents and nonresidents - are required to successfully pass the Hawaii Insurance License Exam (except crop adjuster)."That is the only flat no-reciprocity statement on this site, and it makes this the one adjuster license here with a single route. The paper itself is the Hawaii Adjuster examination, which the Division uses for the independent and the public license alike. 431:9-226(a) draws the line the license sits on: an independent adjuster acts only on behalf of insurers, and 431:9-227 forbids an adjuster who is also a producer from adjusting a loss where the producer's pay for selling the insurance turns mainly on the adjustment.
