Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by a license already held or experience.

  1. Route 1 Hold a life line of authority for at least a year and notify

    No state exam for this license

    • 1 year a resident insurance producer license with a life line of authority, in Delaware or in the producer’s home state, held for at least one year, together with a Delaware nonresident producer license where the producer is not a resident

    18 Del. C. 7503(b): a life insurance producer so licensed "meets the licensing requirements of this section and is permitted to operate as a viatical settlement broker". No examination and no course. The duty that comes with it has a clock on it: within 30 days of the first day of operating as a broker the producer must notify the Commissioner on the prescribed form, pay the fee and acknowledge that they will operate under the Act.

  2. Route 2 Apply to the Commissioner without a life producer license

    No state exam for this license

    • Competence, trustworthiness and good faith; a good business reputation and experience, training or education qualifying the applicant for the business; a certificate of good standing where the applicant is a legal entity; and an anti-fraud plan

    18 Del. C. 7503(a) and (h). A broker who is not coming through the life producer door applies like a provider and is investigated like one, but two of the provider's findings do not reach a broker on the section's own wording: the detailed plan of operation at 7503(h)(1) and the $250,000 at 7503(h)(4) are both conditioned on the applicant being a provider. There is still no examination and no course. 7503(c) then carves out the professional adviser entirely: an attorney, certified public accountant or accredited financial planner retained to represent the viator, and not paid by the provider or broker, may negotiate contracts for the viator without this license at all.
