Title insurance in Delaware. It is the one line here a lawyer walks into: the Code excuses an applicant who is admitted to practice law in Delaware from any prelicensing education and from the examination, and asks everybody else to sit it.

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination, a license already held, a license held in another state or moving here already licensed.

Route 1 Pass the examination

18 Del. C. 1705(a) asks a resident individual applying for a license to pass a written examination unless exempt under 1709, and it is the only examination on this site that tests insurance ethics as a subject in its own right, "as established by the Commissioner", alongside the lines applied for and general insurance knowledge. 1706(a) is the closed list of what the Commissioner must find before approving the application: at least 18 years old, no act that is a ground for denial under 1712, the fees under chapter 7 paid, the examinations passed unless specifically exempted, and a residency test Delaware writes more tightly than anybody else. No course is in it. The score keeps for 12 months under 1705(e), and 1705(d) puts no cap on how many times somebody may sit it. That residency test is 1706(a)(5), and it is worth reading before renting an address: an applicant for a resident producer license must either be a Delaware resident or work for a business entity licensed to conduct the business of insurance in Delaware that maintains a physical location here open to the public and conducts business from it. The subsection then says in terms that registered agent services and a Delaware post office box do not establish it.

18 Del. C. 1709(c): an applicant for a license as a producer for title insurance who is an attorney licensed to practice law in this State is not required to complete any prelicensing education or examination. Maine writes the same exemption at 1420-H(3)(C) and stops there too; South Dakota goes further and exempts attorneys from every line rather than only this one. Delaware's version is the narrow one, and it is worth knowing that the bar admission has to be Delaware's rather than anywhere's.

18 Del. C. 1709(a). Somebody previously licensed for the same lines of authority in another state completes neither prelicensing education nor an examination. The exemption holds while that other license is current, or if the application arrives within 90 days of its cancellation and the prior state certifies good standing at that point, or the NAIC producer database shows it for the line being asked for.

90 days Licensed as an insurance producer in another state carrying the Title Insurance line of authority there, and applying to become a Delaware resident licensee within 90 days of establishing legal residence.
18 Del. C. 1709(b). Somebody licensed as a producer, adjuster or appraiser in another state who moves here has 90 days from establishing legal residence to apply as a resident licensee under 1706, written as a duty rather than an option. No prelicensing education or examination is required for a line of authority previously held in the prior state except where the Commissioner determines otherwise by regulation.

No national seller sells a course for this license. Delaware sets a title paper, InsDE-Title70, and nobody sells preparation for it here. 18 Del. C. 1709(c) is part of why the market is thin: a Delaware attorney takes this license with neither course nor examination.
