18 Del. Admin. Code 1406 section 12.0 is the home state certificate of authority and section 12.2 is the closed list of what the NAIC Uniform Application must carry: organizational documents and every amendment to them, the bylaws or similar documents governing internal affairs, an NAIC Biographical Affidavit for each member of the governing board and each principal officer or partner, audited annual financial statements for the two most recent fiscal years proving a positive net worth, and a business plan detailing staffing and the capability to supply experienced and qualified personnel in claims processing, record keeping and underwriting. Nothing in the regulation asks for a course, an hour count or an examination of the applicant, and section 17.3 uses the word examination in the other sense, pointing at the Commissioner's power to examine the administrator's affairs under Chapter 3. 12.5 is the refusal test, on competence, trustworthiness, financial responsibility and reputation, and on any administrator authority denied or revoked for cause anywhere. 12.8 attaches a surety bond only to an administrator handling governmental or church self-funded plans, at the greater of $100,000 or ten per cent of the aggregate self-funded coverage it handles. 12.6 makes the certificate open-ended: it stays valid while the administrator remains in business here and in compliance, rather than expiring on a renewal date.

18 Del. Admin. Code 1406 section 14.0. An administrator without a Delaware home state certificate files the Uniform Application with a letter of certification, or the Commissioner verifies its home state status through the NAIC's database instead. 14.2 is the condition the route turns on: a nonresident is ineligible unless its home state has adopted this regulation or a substantially similar administrator law. 14.3 then obliges the Commissioner to issue promptly on a complete application, subject only to 14.2 and to 14.8, which lets the Commissioner delay or refuse where something learned since the home state licensed the applicant means it cannot satisfy the regulation. 14.7 carves out the administrator whose Delaware duties are limited to administering a group policy or plan covering no more than a hundred lives in this state in total, which needs no Delaware certificate at all.
