Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination or a license already held.

  1. Route 1 Pass the examination

    State exam required

    Bail is not qualified under chapter 17 and reading it there gets the answer wrong. 18 Del. C. 4333(c) is this license's own closed list of six: at least 18, a Delaware resident, no act on a list of fourteen, the chapter 7 fees paid, the examination passed "unless specifically exempted from such examination by this subchapter", and no suspension or prohibition by any court or state. No course is in it, which is the sourced zero. 4337(a) then requires every natural person intending to apply to personally take and pass a written examination whose scope is all aspects of the bail bond business, and Delaware's examination vendor sets InsDE-BB23, one hour. Alongside it sit a $50,000 bond under 4336 and, under 4333A, a notice of appointment executed by a surety insurer, which by its own terms certifies the applicant competent, financially responsible and suitable. The appointment runs until the license ends or somebody files a termination.

  2. Route 2 Reinstate a lapsed license within twelve months

    Exempt from the state exam

    • a Delaware bail agent license lapsed for less than twelve months and neither suspended nor revoked

    18 Del. C. 4337(f), and it is the only exemption in the subchapter. That matters more here than the exemption itself: 4333(c)(5) excuses the examination only where the applicant is "specifically exempted from such examination by this subchapter", so chapter 17's reciprocity at 1709(a) and its residency transfer at 1709(b) do not reach a bail agent, whatever they do for a producer. 4333(c)(2) requires the applicant to be a Delaware resident, and 4333(h) closes the other end: somebody holding a nonresident bail agent license issued under prior law may not renew it unless they satisfy that residency requirement. Delaware licenses no nonresident bail agent at all. All fees and fines on the lapsed license have to be paid in full before the Department approves the reinstatement.
