An Applicant Certification, signed by the person with authority to bind the provider, certifying that they have reviewed sections 10113.1 through 10113.3 of the California Insurance Code and section 2548 of title 10 of the California Code of Regulations
California Insurance Code section 10113.1(r) defines the provider as "a person, other than an owner, who enters into or effectuates a life settlement contract with an owner", and then excludes nine kinds of person from it, including a broker, a purchaser, a financing entity, a related provider trust and an accredited investor or qualified institutional buyer under Regulation D Rule 501 or Rule 144A who buys a settled policy from a provider. The prohibition is flat: nobody may enter into or effectuate a life settlement contract with an owner without this license. There is no course, no examination and no experience bar; the application is form LIC 441-19, filed through OASIS with every form the applicant intends to use attached, and an Entity Identifying Number obtained from the Department first. This is the second-list finding in California: the Producer Licensing Bureau names Life Settlement Provider among its license classes, the page it links sits under the insurers section, and the fee is on the Schedule of Fees and Charges under Certificate of Authority rather than on the producer schedule, at $4,656 under section 10113.2(b)(1).
