    Being inside the definition, which is measured

    • Acting as an agent for an insurer; producing directly or indirectly, or underwriting, gross direct written premium equal to five percent of surplus as regards policyholders in the insurer's last annual statement; and managing all or part of the insurer's insurance business while either negotiating reinsurance for it or adjusting and paying claims

    and one registration for every contract

    • A Wyoming Managing General Agent Registration Form for each insurer the manager holds a contract with, filed within 30 days of executing a new contract where the entity is already registered, with a complete copy of all management contracts and a $100 registration fee

    W.S. 26-46-101 defines it and the Department adds the warning that makes the definition useful: "A person or firm representing itself as a managing general agent may not necessarily fall under the provisions of the MGA Act. If the individual does not perform the activities set forth above, then the individual is not an MGA and would not need to be registered as such."The five percent test then runs in both directions, and the second direction is the one nobody expects: "if production in one year is less that 5% of policyholders surplus the entity must apply for a Wyoming Producer Firm License". Falling under the threshold does not release the entity, it moves it to a different license. Alabama, read the same day, licenses its managing general agent per insurer represented and per class handled and charges $405 each time; Wyoming registers per insurer contract at $100 once. Idaho, Hawaii and Alabama issue one; Oregon and Washington issue none.
