Collects premiums or settles claims for somebody else's employee benefit plan. Wisconsin licenses the administrator and the pharmacy benefit manager out of the same chapter, and which of the two licenses a company needs turns on whether it touches the money.

    The intermediary license, for an individual

    • an active Wisconsin individual intermediary license, which s. 633.14(1)(c)3 requires of an individual applicant in as many words: that the person is licensed to act as an agent

    and the bond

    • A performance bond meeting the specifications the commissioner sets under s. Ins 8.28, signed and sealed and sent to the Office in original. A replacement original is required on a name change, a domicile change, a carrier change or a cancellation, and failure to keep one in force can bring a notice of hearing to revoke.

    and the financial statement

    • Financial statements for the most recently completed fiscal year on a generally accepted accounting basis, showing assets, liabilities and net worth and the results of operations, in the applicant's own name; where they are consolidated with a parent, a deconsolidating spreadsheet breaking the applicant out. They may not be marked confidential and need not be audited.

    ss. 633.13 and 633.14. 633.13(1) covers both licenses in one sentence and settles the overlap between them: "a person may not perform, offer to perform or advertise any service as an administrator or a pharmacy benefit manager unless the person has obtained a license under s. 633.14. A pharmacy benefit manager that also performs services as an administrator need only obtain an administrator license."So a manager that solicits or collects premiums, effects coverage or settles claims takes this license instead of the other one. There is no examination and no course. 633.13(2) lets the commissioner exempt classes of administrators by rule where the functions need no special competence or trustworthiness, and the Office takes that exemption on its own form for an applicant that collects only contributions to self-funded ERISA plans, administers no stop-loss premium and performs no function for a multiple employer welfare arrangement. Records of every transaction between the administrator, the insurers and the insured persons are kept five years after the contractual relationship ends.

The Wisconsin products sellers do carry are all for a major producer line or for the adjuster paper; Aceable sells nothing in Wisconsin at all. Wisconsin asks for no course here and its examination vendor publishes no paper for this license, so there is nothing to sell.
