The Texas Adjuster: Public Insurance license

Adjuster: Public Insurance

Adjusts a Texas loss for the policyholder rather than for the insurer. It is the one Texas adjuster license with no course route at all: chapter 4102 waives its examination only for reciprocity.

Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination, a license held in another state or a license already held.

  1. Route 1 Pass the examination

    State exam required

Experience or training in assessing loss

    • Sufficient experience or training in assessing property values and physical loss, and sufficient information about property insurance contracts and adequate knowledge to be a public insurance adjuster

    and financial responsibility

    • A surety bond of $10,000 or more with the applicant listed as its sole principal, filed on the Public Insurance Adjuster Bond (Form FIN509) with a copy of the original bond

Tex. Ins. Code 4102.053(a) is the resident list and it has no course in it: 18 years old, a citizen or federally compliant, a Texas resident, trustworthy, no felony in ten years, sufficient experience or training in assessing property values and physical loss, sufficiently informed about property insurance contracts, adequate knowledge, the examination passed or waived, financial responsibility under 4102.105 and fingerprints under 4001.103. Neither the statute nor TDI's page offers the approved-course waiver that chapter 4101 gives every other adjuster license, which is two adjuster chapters in one state disagreeing. The applicant also has to tell TDI which client contract they will use, either their own meeting 28 TAC 19.708 or TDI's own Form FIN535, and TDI accepts no assumed name for a public insurance adjuster.

  2. Route 2 Hold the license in a reciprocal state that examines for it

    Exempt from the state exam

    • a public insurance adjuster license in good standing in a state that requires an examination for it and with which TDI has a reciprocal agreement

Tex. Ins. Code 4102.058 is narrower than the ordinary reciprocity clause: the other state must itself examine for the license, and TDI must have a reciprocal agreement with it. This is the only examination waiver chapter 4102 grants.

  3. Route 3 Reinstate a license that expired between 90 days and a year ago

    Exempt from the state exam

    • a Texas public insurance adjuster license that expired more than 90 days and less than one year ago

TDI lists an expired license among the reasons no examination is needed, and it is bounded at both ends: inside the first 90 days the renewal process is used instead, and after a year the examination comes back. So this route begins where renewal stops.

The Texas Department of Insurance requires no pre-licensing course for this license, so there is nothing here to price. Anyone selling you one is selling exam practice.
