A determination by the director that the applicant is competent and trustworthy with respect to the handling of surplus lines
SDCL 58-32-7 is one sentence and it is the whole qualification: any individual licensed in South Dakota as an insurance producer, whom the director determines to be competent and trustworthy with respect to the handling of surplus lines, may be licensed as a surplus line broker. There is no prelicensing course, no hour count and no separate examination in chapter 58-32. The same section carries the limit on when the license is needed at all: nobody must hold it where the selling, soliciting or negotiating takes place in the insured's home state and that home state is not South Dakota. SDCL 58-32-8 makes the application a form furnished by the director and sends the fee to 58-2-29, which prices the original license at $50 and the biennial renewal at $100. SDCL 58-32-9 then subjects the license to the ordinary producer licensing provisions of chapter 58-30, and 58-32-13 is the consequence a holder should know: suspending or revoking the surplus line license affects every other license the broker holds.
