Reinsurance Intermediary

One license covering both trades chapter 46 defines, the intermediary-broker who places cessions for a ceding insurer and the intermediary-manager who runs a reinsurer's business. Which one an applicant is decides whether a bond is required, and the manager's is per reinsurer represented.

    • a South Carolina producer license, where the office is in this State

    • or

      a producer license in the state where the office is, plus a South Carolina reinsurance intermediary license, which may be a nonresident one

    S.C. Code 38-46-30(A) and (B) set the qualification and neither has a course or an examination in it. Subsection (D)(1) is the grant: the Director may issue the license to somebody who has demonstrated compliance with the chapter, completed the application form, and paid $100 on issue and $100 on each annual renewal. Two things are worth reading twice. The bond in (C) attaches only to an intermediary-manager and is $50,000 for each reinsurer represented, so the security scales with how many companies the manager acts for rather than with the size of the business. And a nonresident applicant must name a South Carolina resident to receive process, with any change notified in thirty days and not effective until the Director acknowledges it. Attorneys acting in their professional capacity are exempt from the section.
