Portable Electronics Vendor

Sells cover on portable electronic devices at the counter where they are sold or leased. The license sits on the vendor, and it is the only South Carolina license whose fee somebody else pays: the Department asks that the $1,000 check be issued by the supervising entity, the licensed insurer or business entity that appoints the vendor.

    A supervising entity

    • A business entity licensed as a property and casualty insurer, or as an insurance producer with a property and casualty line of authority, which appoints the vendor, submits the whole application packet, pays the fee and keeps the registry of authorized locations

    and a training program the supervising entity runs

    • A training program developed by the insurer or its supervising entity, delivered to every employee and authorized representative directly engaged in selling the cover, giving basic instruction about the product and the disclosures S.C. Code 38-97-40 requires. It is the licensee's to arrange rather than the applicant's to buy: no hours, no syllabus, no approval, and the Department sees only an outline of the materials and only on request.

    S.C. Code 38-97-30(A) requires the license and (B) makes it cover every employee and authorized representative at every location where the vendor does portable electronics transactions, provided each of them has completed the training. That training is the licensee's to arrange rather than the applicant's to buy: 38-97-50(A)(3) puts it on the insurer or its supervising entity, sets no hours and no syllabus, and asks only that it be basic instruction about the product and the disclosures. Where it is delivered electronically the supervising entity must run a supplemental program overseen by its own licensed employees. There is no examination. The Department's page adds what the chapter does not: the application goes through NIPR and is completed by an officer of the vendor, a certificate of authority or existence or a partnership agreement comes with it, and "the check must be issued by the supervising entity... and made payable to the South Carolina Department of Insurance".

The training belongs to the supervising entity to give the vendor's own counter staff, with no hours and no syllabus set, and South Carolina gives no portable electronics examination. There is nothing a school can sell against this license.
