A sworn application naming an employee or officer of the vendor as the person responsible for the vendor’s compliance, and the location of the home office; where the vendor draws more than half its revenue from portable electronics insurance, the same information for every officer, director and holder of ten percent or more of any registered class of securities
27-2.7-2(a) requires the vendor to hold the license and 27-2.7-2(b) then makes it cover everybody: the license authorizes any employee or authorized representative of the vendor to sell or offer the coverage at each location where the vendor does portable electronics transactions. So nobody at the counter is licensed and nobody at the counter sits an examination. 27-2.7-7 is the application and it asks for two things and one condition: a person responsible for compliance, the home office address, and, where more than half the vendor’s revenue comes from this insurance, the same details for every officer, director and ten percent shareholder of record. The disclosure threshold is what marks the vendor whose real business is the insurance rather than the phone. The license runs two years and expires on 31 May, the fee is $200 initial and $200 on renewal, and a supplemental application goes to the Department alongside the NIPR filing, in a different version for a new license and for a renewal. 27-2.7-7(c) subordinates the whole thing to the Producer Licensing Act except where the two conflict, in which case this chapter wins. One consequence worth knowing sits in the adjuster chapter rather than here: 27-10-2(13) exempts a person adjusting portable electronics claims from adjuster licensing altogether, so this product is outside both licenses at both ends.
