Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination or a license already held.

  1. Route 1 Pass the viatical settlement broker examination

    • The Pennsylvania viatical settlement broker examination, whose results are valid for one year from the date sat

    and what the Department finds

    • Being at least 18, able to read and write English, maintaining a business or legal address in Pennsylvania for a resident license, and possessing the requisite professional competence, general fitness and integrity of character

    The examination is the Department's and not the statute's, which is worth saying plainly: section 3 of the Viatical Settlements Act, Act 107 of 2002, asks for an application, a fee and the findings at section 3(i), and names no examination anywhere. The Department's own licensing requirements sheet then opens its application steps with "pass the appropriate examination OR claim an examination [exemption]". Section 3(i)(3) is the closest the act comes, asking that the applicant "has a good business reputation and has had experience, training or education so as to be qualified in the business", with no period and no hours on any limb. The sheet also records that there is no reciprocity for this license at present, where section 3(d)(2) of the act would waive the application requirements for a nonresident whose home state reciprocates.

  2. Route 2 Hold the life line for a year and claim the exemption

    Exempt from the state exam

    • A Pennsylvania insurance producer license with life authority

    and a year of it, anywhere

    • 1 year A life line of authority held in Pennsylvania or any other state for at least one full year immediately before the application

    The Department states the exemption in two limbs and both have to be met: the applicant must be "licensed in PA as an insurance producer with life authority" and must "have been licensed with a life line of authority in this or any other state for at least one full year immediately prior to submitting this application". So the Pennsylvania license is required in the present tense and the year may have been served anywhere. Fourteen other states here recognize the same year in one form or another: Washington, Idaho and Minnesota let a life producer of a year's standing operate as a broker on a notification, and Hawaii asks for the year, a separate broker license and a notification. Pennsylvania asks for the year and a separate license and no notification.

Pennsylvania does examine a viatical settlement broker, on the Department's own requirement rather than the statute's, so there is a paper to prepare for, and no national seller prepares anybody for it.
