Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination or a license held in another state.

  1. Route 1 Pass the public adjuster examination

    The examination

    • The Pennsylvania public insurance adjuster examination, registered for and sat through PSI Services

    and fingerprints

    • Fingerprints taken at an IdentoGO enrollment center under the Insurance Department's service code, registered for in advance and submitted only after the examination is passed and the application filed

    and the bond, before any business

    • A bond in the minimum penal sum of $20,000, with sureties the Insurance Commissioner approves, executed and delivered to the Commissioner before transacting any business as a public adjuster

    and an approved contract, before any business

    • A written contract on a form the Department has approved, executed in duplicate with the insured; the Department publishes a sample and a contract that deviates from it in any manner has to be submitted for approval before use

    Section 2.2(a) of the Public Adjuster Licensing Law, Act 72 of 1983 as rewritten by Act 21 of 2012, is six findings and the substantive ones are the examination, the fees and "the general fitness, competence and reliability sufficient to satisfy the department that the applicant is worthy of licensure". No course and no experience anywhere in the act. The bond at section 4(a) and the contract at section 5(a) are conditions of transacting business rather than of issuing the license, which is why the Department lists them under additional requirements and says they may be obtained after licensure but must be in place before any business. Section 5(c) is the fence worth knowing: "No public adjuster shall act in any manner in relation to claims for personal injury or automobile property damage."So the one claims license Pennsylvania issues to work for the policyholder is barred from the auto claim that its other claims license, the motor vehicle physical damage appraiser, exists to estimate. Section 5(a.2) gives the insured three calendar days to rescind, where Minnesota gives 72 hours.

  2. Route 2 Hold a resident public adjuster license in another state

    Exempt from the state exam

    The home state license

    • A current resident public adjuster license in another state or territory, proved in a form or manner the Department finds acceptable

    and the bond and the approved contract

    • The $20,000 bond and the Department-approved written contract, both of which condition transacting business here rather than the class of applicant

    Section 2.5(a) issues the nonresident license on proof of the home state license and the fee, with no examination. It is not unconditional: "The department may deny the application if the individual's home state does not award nonresident public adjuster licenses to resident licensees of this Commonwealth on the same basis."Section 2.2(a)(3) is worded as "passed or is exempt from" the examination and the act defines the exemption nowhere else, so this is it.
