    The registration

    • Registration with the Department on an application form that reflects the reporting requirements of section 704.1, filed through Sircon, for a two-year term

    and the fee

    • $500 to register and $500 to renew, being the ceiling section 501(b)(3)(ii) sets

    Chapter 5 of the Pharmacy Benefit Reform Act registers rather than licenses, on a two-year term, and Act 77 of 2024 rewrote what it may cost. Section 501(b)(3) used to cap the fee at $1,000 for everybody; it now reads $10,000 for a pharmacy benefits manager or auditing entity and $500 for a pharmacy services administration organization, and the Department charges the ceiling in every case. An initial application fee is nonrefundable and a renewal fee comes back if the renewal is not granted, which is a distinction very few fee provisions on this site draw. There is no competence finding, no examination and no course anywhere in the chapter. Section 501(a.1), added by Act 77 of 2024, is the whole registration requirement and it ends with a sentence that says what the register is not: "Nothing under this subsection shall be construed as requiring a health insurer, health benefit plan or PBM to enter into a contract with a PSAO."So the Commonwealth registers the organization and declines to make anybody deal with it.
