    Character and competence

    • A finding by the superintendent that the applicant is competent and trustworthy, intends to act in good faith in the capacity applied for, has a good business reputation, and has had experience, training or education qualifying them to act in it.

    • An anti-fraud plan meeting Ohio Revised Code 3916.18(G).

    and good standing, for an entity

    • For an applicant that is not an individual, a certificate of good standing from the state of its organization, and the naming of every partner, officer, member or designated employee who will act under the license.

    Ohio Revised Code 3916.03. The license expires on the last day of March after it is issued and every March after that. What is unusual is where the education sits: 3916.03(G) requires fifteen hours of continuing education biennially, related to viatical settlements, on courses the superintendent approves, and there is no pre-licensing course at all. The proof of financial responsibility in 3916.03(D) belongs to the provider rather than to the broker. A license issued to a person other than an individual authorizes all its partners, officers, members and designated employees to act, so the entity license is not a formality over individual ones. Division (H) is Ohio's universal licensing route under Revised Code Chapter 4796, which takes another state's license, satisfactory work experience or a certification in place of the ordinary application.
