Ohio Revised Code 3905.06(B)(6) makes variable life and variable annuity products a line of authority in its own right, and 3905.06(A)(1)(e) attaches the FINRA condition to it. What makes this line different from the other five is an omission: 3905.04(B) lists the lines that require an Ohio examination as divisions (B)(1) to (5) of 3905.06, plus title and surety bail bond, and (B)(6) is not among them. So there is no Ohio paper, no twenty hours, and no course completion certificate. The Department's own list of the examinations it offers runs to nine and has no variable one on it, which is the same answer from the other end. The Department adds a second condition that the statute does not: O.A.C. 3901-6-02(K) forbids soliciting life insurance in correlation with a mutual fund or other security unless the agent is also licensed by the Ohio Division of Securities under Revised Code Chapter 1707, and whether that reaches a given sale depends on what is being sold.
