Sells cover provided under variable life insurance contracts and variable annuities in North Dakota. The Code lists it among the five lines a producer may be licensed to market and the Department's rule then adds two conditions the Code does not carry: the qualifying paper is the Life and annuity one, because there is no variable examination in this state, and the applicant must first be licensed as a securities salesman under North Dakota law.

Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination, a license held in another state or moving here already licensed.

  1. Route 1 Pass the Life and annuity examination

    • a North Dakota securities salesman license, obtained before the variable line is applied for

    N.D. Admin. Code 45-02-02-04(1) is a five-row table of line against paper, and the fifth row reads "Variable life and annuity | Life and annuity": the variable line is qualified on the life paper rather than on one of its own. PSI's index of North Dakota papers agrees by omission, listing ten and none of them variable. This page said until 2026-08-20 that the Code "conditions it on nothing else", which was read off N.D.C.C. 26.1-26-11(5) alone and missed the rule. The rest of the route is the producer route: 26.1-26-13.2(1) asks a resident individual applying for a producer or consultant license to pass a written examination unless excepted under 26.1-26-25, and 26.1-26-13.3(1) is the closed list of what the commissioner must find before approving the application, being at least 18 years old, no act that is a ground for denial under 26.1-26-42, the fees at 26.1-01-07 paid, and the examinations passed for the lines applied for. A criminal history record check comes with it, and 26.1-26-15 adds that the applicant must be deemed competent, trustworthy, financially responsible and of good personal and business reputation. No course is in any of it, and the reason is a repeal with a citation: 26.1-26-15.1 was headed Prelicensure education and now reads, in its entirety, "Repealed by S.L. 2001, ch. 262, section 136". N.D. Admin. Code 45-02-02-11 adds the second condition and it is not an education one either: "an applicant for a license to do business in the variable life and annuity line must first become licensed as a securities salesman under North Dakota law". A securities license first, then the life paper, then this line.

  2. Route 2 Hold the same line in another state

    • an insurance producer license carrying the Variable Life and Variable Annuity line of authority in another state

    and securities license

    • a North Dakota securities salesman license, obtained before the variable line is applied for

    N.D.C.C. 26.1-26-25(1). Somebody previously licensed for the same lines of authority in another state may not be required to complete any prelicensing education or examination. The exception holds while that other license is current, or if the application arrives within 90 days of its cancellation and either the prior state certifies good standing at that point or the NAIC producer database shows it for the line being asked for. N.D. Admin. Code 45-02-02-11 is not an examination requirement and is not waived with one: an applicant for this line must first be licensed as a securities salesman under North Dakota law, whichever way in they take.

  3. Route 3 Move to North Dakota and apply within 90 days

    • 90 days Licensed as an insurance producer in another state carrying the Variable Life and Variable Annuity line of authority there, and applying to become a North Dakota resident licensee within 90 days of establishing legal residence.

    and securities license

    • a North Dakota securities salesman license, obtained before the variable line is applied for

    N.D.C.C. 26.1-26-25(2). Somebody licensed as a producer in another state who moves to North Dakota has 90 days from establishing legal residence to apply as a resident licensee, written as a duty. Neither prelicensing education nor an examination may be required for a line of authority previously held in the prior state unless the commissioner determines otherwise by rule. N.D. Admin. Code 45-02-02-11 is not an examination requirement and is not waived with one: an applicant for this line must first be licensed as a securities salesman under North Dakota law, whichever way in they take.
