The North Dakota Surety license

Surety

Writes surety in North Dakota: insurance or a bond covering an obligation to pay somebody else's debts or answer for their default, including faithlessness in a position of public or private trust. The rule defines it and then takes one thing back out of it in the same sentence, which is why a surety licensee is not a bail bond agent here.

Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination, a license held in another state or moving here already licensed.

  1. Route 1 Pass the Casualty examination

    N.D. Admin. Code 45-02-02-04(4) is the whole of it: "An applicant for a license with the line of authority of surety shall take and pass the casualty examination."Surety is a line of authority the Department grants and it has no paper of its own, which is why PSI's index of ten North Dakota papers does not name it. The same subsection defines the coverage and then excludes bail bonds from it by name, so somebody who wants to write bail takes the separate reduced bail bonds paper under 45-02-02-04(5)(a) instead. N.D. Admin. Code 45-13-01-02(4) lists surety, bonds and fidelity bonds among the products inside the Casualty line. No pre-licensing course is required.

  2. Route 2 Hold the same line in another state

    Exempt from the state exam

    • an insurance producer license carrying the Surety line of authority in another state

    N.D.C.C. 26.1-26-25(1). Somebody previously licensed for the same lines of authority in another state may not be required to complete any prelicensing education or examination. The exception holds while that other license is current, or if the application arrives within 90 days of its cancellation and either the prior state certifies good standing at that point or the NAIC producer database shows it for the line being asked for.

  3. Route 3 Move to North Dakota and apply within 90 days

    Exempt from the state exam

    • 90 days Licensed as an insurance producer in another state carrying the Surety line of authority there, and applying to become a North Dakota resident licensee within 90 days of establishing legal residence.

    N.D.C.C. 26.1-26-25(2). Somebody licensed as a producer in another state who moves to North Dakota has 90 days from establishing legal residence to apply as a resident licensee, written as a duty. Neither prelicensing education nor an examination may be required for a line of authority previously held in the prior state unless the commissioner determines otherwise by rule.

North Dakota gives no surety paper at all: the line is examined on the casualty paper, and the casualty products already shelved against the Casualty license are what prepares for it. No national seller prices a North Dakota surety product.
