Sells, solicits or negotiates travel insurance in North Dakota through a licensed insurer, and carries the travel retailers who offer it over a counter. Nobody starts here: the Code defines the licensee as somebody who already holds one of three other things, and the license is laid on top of that.

At licensure and annually thereafter, a register on the commissioner's form of every travel retailer offering insurance on the producer's behalf, with each retailer's name, address, contact and federal tax identification number, and a certification that the retailer complies with 18 U.S.C. 1033.
N.D.C.C. 26.1-26-54(2)(a) defines the limited lines travel insurance producer as a licensed third-party administrator, a licensed insurance producer including a limited lines producer, or a travel administrator, and 26.1-26-54(3)(a) then says the commissioner may issue the license to an individual or business entity that applies. That combination is what makes this a license in North Dakota where the same definition makes it none in Oregon: ORS 744.101(8) defines the person and issues nothing, and 26.1-26-54(3)(a) issues something. N.D. Admin. Code 45-02-02-04(3) exempts the applicant from examination, describing the coverage as trip cancellation, trip interruption, baggage, life, sickness and accident, disability and personal effects when limited to a specific trip and sold with transportation provided by a common carrier. The holder is also exempt from continuing education under 26.1-26-54(6), and 26.1-26-54(12) makes the whole thing unnecessary for anybody already licensed in a major line, who may sell travel insurance without it. N.D.C.C. 26.1-26-54(3)(b)(2). The travel retailer itself takes no license: it is registered by the producer and is authorized to be paid for the work only through that registration, under 26.1-26-54(9). The producer stays responsible for what the retailer does under 26.1-26-54(11), must designate one licensed employee to answer for compliance, and must train every retailer employee who offers the cover, on material the commissioner may review and approve.
