The North Dakota Insurance Consultant license

Insurance Consultant

Advises on insurance for a fee in North Dakota rather than selling it. The Code excuses attorneys, trust officers, actuaries and certified public accountants acting in their own professional capacities, and excuses licensed producers too, so this license is for somebody who advises and does not sell. It is narrower than it was: the Department took public adjusting out of it with effect from 1 July 2019 and issues a separate Public Adjuster license for that work. It sits under the same examination section as the producer license and needs no pre-licensing course.

Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination, a license held in another state, moving here already licensed or a license already held.

  1. Route 1 Pass the examination

    State exam required

    N.D.C.C. 26.1-26-13.2(1) asks a resident individual applying for a producer or consultant license to pass a written examination unless excepted under 26.1-26-25, and 26.1-26-13.3(1) is the closed list of what the commissioner must find before approving the application: at least 18 years old, no act that is a ground for denial under 26.1-26-42, the fees at 26.1-01-07 paid, and the examinations passed for the lines applied for. A criminal history record check comes with it, and 26.1-26-15 adds that the applicant must be deemed competent, trustworthy, financially responsible and of good personal and business reputation. No course is in any of it, and the reason is a repeal with a citation: 26.1-26-15.1 was headed Prelicensure education and now reads, in its entirety, "Repealed by S.L. 2001, ch. 262, section 136". The consultant license is named in the same sentence of 26.1-26-13.2(1) as the producer license, which is why the examination reaches it. 26.1-26-10 then says who does not need one at all: an attorney acting in a professional capacity, a licensed insurance producer or surplus lines insurance producer, a bank trust officer acting in the normal course of employment, and an actuary or certified public accountant giving information, recommendations, advice or services professionally. One thing this license stopped covering: the Department's notice on its own consultant page reads "Effective July 1, 2019, the North Dakota consultant license will no longer include the authority to act as a public adjuster", and a consultant then acting as a public adjuster had to reapply for the new license. Public adjusting is now its own license under chapter 26.1-26.8, with its own paper on PSI's index.

  2. Route 2 Hold the same line in another state

    Exempt from the state exam

    • an insurance producer license carrying the Insurance Consultant line of authority in another state

    N.D.C.C. 26.1-26-25(1). Somebody previously licensed for the same lines of authority in another state may not be required to complete any prelicensing education or examination. The exception holds while that other license is current, or if the application arrives within 90 days of its cancellation and either the prior state certifies good standing at that point or the NAIC producer database shows it for the line being asked for.

  3. Route 3 Move to North Dakota and apply within 90 days

    Exempt from the state exam

    • 90 days Licensed as an insurance producer in another state carrying the Insurance Consultant line of authority there, and applying to become a North Dakota resident licensee within 90 days of establishing legal residence.

    N.D.C.C. 26.1-26-25(2). Somebody licensed as a producer in another state who moves to North Dakota has 90 days from establishing legal residence to apply as a resident licensee, written as a duty. Neither prelicensing education nor an examination may be required for a line of authority previously held in the prior state unless the commissioner determines otherwise by rule.

  4. Route 4 Hold the North Dakota producer license for those lines and cancel it

    • a North Dakota insurance producer license carrying the lines the applicant seeks to consult in, held within the twelve months before the consultant application is filed, and canceled before the consultant license issues

    N.D. Admin. Code 45-02-02-04(6) excuses an applicant who holds a North Dakota producer license from the testing requirement for the lines on it, provided the license was held within the twelve months preceding the consultant application, and then requires the producer license to be canceled before the consultant license may issue. 45-02-02-02(4)(b) says the same thing as a prohibition: nobody holding a producer or surplus lines producer license may obtain and simultaneously hold a consultant license, and any such license must be canceled first. So this route is a swap rather than an addition, and it is the reason the exam route above exists for everybody else.
