Route 1 Register the retailers and apply

Designated responsible agent

A designated responsible agent who is one of the applicant's own licensed individual insurance producer employees, responsible for compliance with New Mexico's travel insurance laws and rules.

A register naming each travel retailer offering travel insurance on the applicant's behalf and the officers who direct or control it, maintained and updated at least once a year, submitted to the superintendent on reasonable request, and certified as complying with federal law.

Compliance with the fingerprinting requirements for insurance producers of the applicant's resident state, by the designated responsible agent, the president, the secretary, the treasurer and every other officer or person who directs or controls the applicant's insurance operations.

A program of instruction or training, which the superintendent may review, given to every employee and authorized representative of the travel retailer whose duties include offering and disseminating travel insurance, covering at a minimum the types of insurance offered, ethical sales practices and the required disclosures.
NMSA 59A-64-3, enacted by Laws 2025, chapter 127. The travel retailer itself is not licensed: it may give general information about the cover and the price, and 59A-64-3(C)(3) requires it to tell prospective purchasers in writing that it is not qualified or authorized to answer technical questions about terms and conditions. The training requirement is the fourth item above and it is unusual in landing on the licensee as a condition of its own license rather than on the people trained. 59A-64-2(H) draws the line the Act turns on: travel assistance service, which runs from concierge services to passport replacement, "is not insurance and is not related to insurance".
