A finding by the superintendent that the temporary license is necessary for the servicing of an insurance business in accordance with the Insurance Code. New Mexico names no grounds and leaves the judgment entirely to the superintendent.
NMSA 59A-11-4. Subsection A says the application is made the same way as for a permanent license, with whatever modification the superintendent prescribes, "and without payment of examination fee", so the $75 the fee schedule charges per grouping of kinds of insurance is not charged here. Subsection B caps the term at 180 days and gives the superintendent the whole of the discretion: unlike the temporary licenses of Ohio and Tennessee, which each list four grounds taken from the NAIC model, New Mexico's names none. The 2016 amendment, effective 1 July 2017, is what added the power to issue without an examination. The fee schedule prices it separately at 59A-6-1(E)(4), $30 to file the application.
