The New Jersey Registration to Negotiate Viatical Settlements license

Registration to Negotiate Viatical Settlements

What replaced a license New Jersey stopped issuing. Since 2005 there is no viatical settlement broker license here: a life producer of a year's standing registers instead, and registers only after the first contract has been negotiated.

Every way to qualify

  1. Route 1 Hold a life producer license, then register within thirty days

No state exam for this license

    The producer license underneath it

    • 1 year a New Jersey life insurance producer license, plus a resident insurance producer license held in the applicant's home state for not less than one year

    and the registration

    • Notice to the commissioner and payment of the fee not less than 30 days from the first date of negotiating a viatical settlement on behalf of a viator. Individuals and business entities both register, and the registration remains in effect for as long as the New Jersey life producer license is in good standing.

The Department states the change in one sentence: "Effective December 21, 2005, N.J.S.A. 17B:30B-1 et seq. creates new requirements for viatical settlement providers and those who negotiate viatical settlement transactions. New Jersey will no longer issue Viatical Settlement Broker licenses."That makes this the second closed license on this site, after Alabama's service representative, and the only one replaced by a registration rather than left to lapse. The Act itself, at 17B:30B-3(b), requires the producer to be licensed here and to have held a resident license at home for at least a year, deems the producer to represent only the viator whatever the compensation, and gives thirty days from the first day of negotiating to notify. The transition clause let anybody who had lawfully negotiated viatical contracts for a year before the effective date carry on for one more year provided they registered. There is no examination and no course.

No national seller sells a course for this license. The New Jersey products sellers do carry are all for a major producer line or for the adjuster paper; Aceable sells nothing in New Jersey at all. The registration rests on a life producer license already held, so what a reader needs is a Life course, and those are priced on the Life page.
