The New Jersey Viatical Settlement Provider license

Viatical Settlement Provider

Buys the life policy from the person insured by it. New Jersey licenses the provider where it merely registers the person who negotiates the sale, and it is the only half of the viatical trade the state still issues a license for.

    • A license from the commissioner of the state where the viator lives, obtained before operating as a viatical settlement provider. There is no examination, no course and no producer license underneath it.

N.J.S.A. 17B:30B-3(a): "A person shall not operate as a viatical settlement provider without first obtaining a license from the commissioner of the state of residence of the viator."The Act took effect on 2005-12-21 and it is the same Act that abolished the broker license, so the two halves of the trade were separated in one stroke: the buyer is licensed and the negotiator is registered. 17B:30B-3(b)(2) is the fiduciary rule that sits between them, deeming a life producer who negotiates to represent only the viator, whatever the manner of the producer's compensation.

No national seller sells a course for this license. The New Jersey products sellers do carry are all for a major producer line or for the adjuster paper; Aceable sells nothing in New Jersey at all. A provider is licensed on an application with no examination and no course.
