Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by a license already held or a license held in another state.

  1. Route 1 Hold a Montana producer license

    No state exam for this license

    The underlying producer license

    • a Montana insurance producer license, which 33-2-1701(1) and (2) require of a broker keeping an office here and of a manager acting for a reinsurer domiciled here or keeping an office here

    and the application, naming everybody who will act

    • An application naming every person authorized to act under the license. A license issued to a firm or association authorizes all its members and any designated employees; one issued to a corporation authorizes all its officers and any designated employees and directors. Everybody has to be named in the application or in a supplement to it.

    and trustworthiness, of everybody named

    • 33-2-1701(5) lets the commissioner refuse the license where the applicant, anybody named on the application, or any member, principal, officer, director or controlling person of the applicant is not trustworthy, or has given cause for revocation or suspension. On written request the commissioner furnishes a summary of the basis for the refusal.

    33-2-1701(4)(a) is the granting sentence and it grants one thing: "The commissioner may issue a reinsurance intermediary license to any person, firm, association, or corporation that has complied with the requirements of this part."Montana is on the one-license side of a split this site has now counted both ways, against Massachusetts, Pennsylvania, Indiana, Michigan, Alaska, Texas, Virginia and Hawaii, which issue two. There is no examination and no course. What separates a broker from a manager here is the conditions attached rather than the paper: 33-2-1701(3) lets the commissioner require a bond and errors and omissions cover of a manager and of nobody else, and 33-2-1702 and 33-2-1705 write different required contract provisions for each. 33-2-1701(6) exempts licensed Montana attorneys acting in their professional capacity, which fifteen states here do and Massachusetts pointedly does not.

  2. Route 2 Be licensed as a producer in a substantially similar state

    No state exam for this license

    The other state's producer license

    • a producer license in another state that has a law substantially similar to Montana's, held by a broker or manager keeping an office in that state, or a Montana nonresident reinsurance intermediary license

    and an agent for service of process

    • A nonresident appoints an agent for service of process under 33-1-605 as a condition precedent to receiving or holding the license, and notifies the commissioner in writing of every change of agent. The change does not take effect until the commissioner acknowledges it.

    33-2-1701(1)(b) and (2)(c) are the nonresident limbs and both turn on the other state's law being substantially similar to Montana's rather than on any finding about the applicant. 33-2-1701(2)(a) is the exception that is not available to a nonresident at all: a manager acting for a reinsurer domiciled in Montana must hold the Montana producer license, with no substantially similar state standing in for it, which is the same asymmetry Massachusetts writes at section 177O(B)(1).

Nothing a national seller sells could reach this license. Montana grants one reinsurance intermediary license covering both roles, on a Montana producer license already held and an application naming everybody who will act under it, with no examination and no course.
