    Who the applicant is and who runs it

    • The name, business address and telephone number of the pharmacy benefit manager and of its principal contact for licensure matters, and the name and address of every member of its board of directors, board of trustees, executive committee or other governing board, of its principal officers if a corporation, or of its partners or members if a partnership or association.

    and proof of registration and audited accounts

    • Proof of registration with the Montana secretary of state, and a copy of the most recent fiscal yearend audited financial statement.

    and every client, and how many people they cover

    • A list of all health carrier, plan sponsor and workers' compensation insurance carrier clients in Montana, and a description of the projected number of enrollees and injured workers to be administered for each of them annually.

    and written compliance procedures

    • A copy of the policies and procedures showing the pharmacy benefit manager has processes to comply with 33-22-170 through 33-22-177.

    33-2-2403(1) makes the license the condition of performing any act or doing business as a pharmacy benefit manager in Montana, and 33-2-2403(2) makes it nontransferable. There is no examination, no course and no competence finding on any individual: what the commissioner reviews is the applicant's ownership, its accounts, its client list and its written procedures. Montana is unusual in reaching workers' compensation carriers, because the application asks for the projected number of injured workers administered as well as of enrollees, and no other pharmacy benefit manager license on this site counts both.
