Life and Disability Consultant

Advises on life and disability insurance for a fee rather than a commission. Montana splits its consultant license in two along the line the Code draws between life insurance and general insurance, and the examination vendor gives each half a two-hour paper.

    The examination

    • The Life and Disability Consultant examination, two hours, which the commissioner requires to determine the applicant's competency and may contract out to a testing service. Montana's passing score is 75 percent.

    and residence, or a state that returns the favor

    • At least eighteen years old, and a resident of Montana or of another state that lets Montanans act as consultants there. A nonresident whose own state does not license consultants may designate Montana as a home state and qualify as if resident here.

    and a background examination

    • A licensing background examination under 33-17-220, which is fingerprints and a criminal history check sent to the Montana Criminal Records Division.

    and a written memorandum before any fee

    • A written memorandum signed by the party to be charged, setting out the services to be rendered and the amount to be paid. 33-17-511 makes it the condition of being paid at all: a consultant may receive consideration for life and disability advice only on such a memorandum.

    33-17-504 is where the split is made and it is made by citation rather than by name: the commissioner may issue a consultant license to somebody who has met the requirements "with respect to either life insurance, meaning all of those kinds of insurance authorized in 33-1-207, 33-1-208, 33-20-1001, 33-21-103, 33-22-501, and 33-22-601, or general insurance... as specified in the license."So there is one consultant license type in the Code with two mutually exclusive scopes, and Pearson gives a two-hour paper for each. 33-17-505 is the examination and 33-17-503 the application, residency and fee. There is no pre-licensing course anywhere in part 5.
