Collects premiums or settles claims for somebody who is not the insurer. Montana registers it rather than licensing it, on a certificate that costs the same to keep every year as it did to get, and acting without one is a fine of at least $500.

    The application and the fee

    • An application accompanied by a fee of $100. The commissioner shall issue the certificate unless the applicant is found not competent, not trustworthy, not financially responsible or not of good personal and business reputation, or has had an application denied for cause within the last five years.

    and a written agreement with the insurer

    • 33-17-602 requires a written agreement between the administrator and the insurer, retained by both for the duration and for five years after, setting out the responsibilities each has taken on.

    33-17-603(1) makes the certificate the condition of acting as or holding out as an administrator, and 33-17-604 is the waiver: the commissioner may waive the certification requirement. There is no examination and no course. What the section examines instead is a firm rather than a person: competence, trustworthiness, financial responsibility and reputation, with a five-year look-back at denied applications. Renewal is annual on or before 1 July at $100, which is the same as the application and unusual on this schedule, where an adjuster and a consultant both pay $50 to apply and $100 to renew. Acting without the certificate is a fine of not less than $500 and not more than $1,500.
