Sells the other side of the trade, the interest in a viaticated policy that an investor buys. It is licensed by the purchaser's residence rather than the viator's, which makes it the only Minnesota insurance license fixed by where the investor lives.

    Qualification for the business

    • Competence, trustworthiness and an intention to act in good faith in the capacity applied for, and a good business reputation with experience, training or education qualifying the applicant for the business

    and standing, for a legal entity

    • A certificate of good standing from the state of domicile, where the applicant is a legal entity, together with the identity of every stockholder holding more than ten percent of the shares, and of the partners, officers, members and employees, on the commissioner's demand

    Minn. Stat. 60A.9572, subd. 2 is the territorial test and it is the only one of its kind here: the license comes from "the commissioner of the state of residence of the viatical settlement purchaser", and where one policy has several purchasers resident in different states the agreement is governed by the state of the largest owner, or, on equal ownership, by a state the purchasers agree on in writing. Subdivision 8's findings reach this license unevenly and the omissions are deliberate: clause (1)'s plan of operation and clauses (4) and (6)'s financial responsibility and antifraud plan are asked of a provider or a broker, not of an investment agent. So this license carries the reputation and competence findings and neither a bond nor an antifraud plan, on the same $750 and $250 fees.
