Administers prescription drug benefits for a health plan, and Minnesota has licensed it through the Department of Commerce since 1 January 2020. At $8,500 to apply and $8,500 every year it is the most expensive license on the Minnesota schedule.

    Who runs the applicant

    • The name, address, official position and professional qualifications of every person responsible for the conduct of the applicant's affairs, meaning all members of the board of directors, board of trustees, executive committee or other governing body, the principal officers of a corporation, or the partners or members of a partnership or association

    and an agent for service of process

    • The name and address of the pharmacy benefit manager's agent for service of process in Minnesota

    and the network adequacy report

    • The network adequacy report Minn. Stat. 62W.05 requires, which is filed with the first application and again with every annual renewal

    Minn. Stat. 62W.03, subd. 1 dates the requirement to 1 January 2020 and subdivision 1(b) makes the license nontransferable. The commissioner has 90 days from a complete application, the network adequacy report and the fee to review it, and 30 days from receipt to ask for more. The term is one year, and a late renewal carries a nonrefundable $500 on top of the $8,500. What the statute never asks for is a competence finding: the application is who runs the applicant, where process is served and whether the network is adequate. Hawaii's chapter 431S is the same shape and asks for a $140 issuance fee; Minnesota asks sixty times that.

No national seller sells a course for this license, and nothing could: chapter 62W grants the license on who runs the applicant, an agent for service of process and a network adequacy report, and asks for no examination, no course and no competence finding at all.
