    Age

    • At least twenty-one years of age

    and financial responsibility

    • Financial responsibility in force in the amounts established by KRS 304.15-700(5)

    806 KAR 9:310 Section 1(1) applies to the provider and to the broker alike: at least twenty-one years of age, a completed Form 8301 NAIC Individual Insurance Producer License Application or the electronic Individual Uniform Application through NIPR, the nonrefundable fee, and financial responsibility in the amounts KRS 304.15-700(5) sets. Section 1(2) then adds the forty hour course and the examination for the broker only, so the provider has neither. Section 3 asks a resident for a criminal background check report obtained through the Kentucky Administrative Office of the Courts. KRS 304.15-700 is what makes the license necessary at all: it prohibits acting as a life settlement provider or broker without first obtaining the appropriate license.
